Two Parts to the Means Test
Attorney Dwight Burton provides complete representation throughout the process.
If your income is less than the average income for your family size in your geographical area, you pass the means test. While you should consult with an attorney to determine if you qualify, the following is the average income for Kentucky families:
- One person: $36,999
- Two people: $44,353
- Three people: $51,046
- Four people: $62,739
The median income can change each year, which adjusts the income level for qualifying.
You will move on to the second part of the means test if your income is more than the average income for families in your area. The test will then consider if the remainder of your disposable income is sufficient to pay back 10 percent or more to your creditors.
If you do not qualify for Chapter 7 bankruptcy, Chapter 13 bankruptcy becomes your next option.
